Special Note: EARMOR Smart Voice Privacy Policy (hereinafter referred to as “this Policy”) only applies to the products and services provided to you by OPSMEN Tech co., ltd. (hereinafter referred to as “OPSMEN Tech” or “we”). Before using this software, please read this policy carefully to ensure that you have fully understood and accepted all terms. Otherwise, please do not register, log in or use it. We have highlighted the important content related to personal sensitive information and your personal data rights in bold, please pay special attention. I. Definition and explanation

  1. Products and services (hereinafter referred to as “this software”).
  2. Service: refers to the services provided to users by OPSMEN Tech co., ltd., the operator of EARMOR Intelligent Voice, including but not limited to translation, voice transcription, meeting summary, AI assistant, copywriting, AI sound detection, etc.
  3. OPSMEN Tech co., ltd.: the operator of EARMOR Intelligent Voice, a high-tech company specializing in artificial intelligence, software and hardware services and intelligent overall solutions. If you want to know more about our company and platform, you can contact us through the contact information provided in Article 9 of this Policy.
  4. User: refers to the user who registers, logs in, and uses this software and activates, browses or uploads data to EARMOR Intelligent Voice, more commonly referred to as “you” in this policy.
  5. Account: refers to the user account you enjoy after completing the real information registration, and the user account is kept by you; you shall be legally responsible for all actions conducted under your account.
  6. Personal data: Personal data refers to various information recorded electronically or otherwise that can identify the personal identity of a natural person alone or in combination with other information, including but not limited to the name, date of birth, ID number, personal biometric information, address, and telephone number of a natural person. For the avoidance of doubt, personal data includes but is not limited to personal sensitive information.
  7. Personal sensitive information: Personal sensitive information refers to personal data that, once leaked, illegally provided or abused, may endanger personal and property safety, easily lead to damage to personal reputation, physical and mental health, or discriminatory treatment. Personal sensitive information includes but is not limited to identity card number, personal biometric information, bank account number, communication content, and health physiological information.
  8. Personal data subject: Personal data subject refers to the natural person identified by personal data.
  9. De-identification: De-identification refers to the process of technically processing personal data so that the personal data subject cannot be identified without the help of additional information.
  10. Anonymization: Anonymization refers to the process of technically processing personal data so that the personal data subject cannot be identified and the processed information cannot be restored.
  11. Device: Device refers to a device that can be used to access EARMOR intelligent voice, such as a desktop computer, laptop, tablet or smartphone.
  12. Unique Device Identifier: A unique device identifier (UUID) is a string of characters that is programmed into a device by the device manufacturer and can be used to uniquely identify the device. Unique device identifiers have a variety of uses, including for advertising when cookies cannot be used. We use information such as device startup time, system version, device model, physical memory, hard disk capacity, system update time, operator, time zone, country, language, IP address, OAID, and advertising identifiers (such as IDFA) to identify devices or applications.
  13. SSL: SSL (Secure Socket Layer), also known as Secure Sockets Layer, is a security protocol implemented on the transport communication protocol (TCP/IP). SSL supports various types of networks and provides three basic security services, all of which use public key and symmetric key technology to achieve information confidentiality.
  14. Information Collection Technology: EARMOR Smart Voice’s “automatic collection” in this policy includes the following methods:
    1. Cookie (Web Cookie) Cookie is a small text file placed by the website server on the client (your computer, mobile phone or other smart terminal) when you browse the web, which can be used to improve your user experience.
    2. Log files (Log files) Log files store some data collected automatically.
    3. ET Tag (Entity Tag) ET Tag is the HTTP protocol header transmitted behind the Internet browser and the Internet server. It can replace Cookie to track individual users, so that we can better understand and improve our services.
  15. IP address: Each device that accesses the Internet is assigned a number called an Internet Protocol (IP) address. These numbers are usually assigned based on geographic regions. IP addresses can usually be used to identify the location of the device when it is connected to the Internet.
  16. The laws, regulations and administrative regulations applicable to this policy are those of the mainland of the People’s Republic of China.

II. How we collect and use your personal data

You understand and agree:

  1. We will use the collected personal data in accordance with the provisions of this Privacy Policy and to realize the functions of our products and/or services.
  2. After collecting your personal data, we will de-identify the data through technical means, and the de-identified information will not be able to identify the subject. Please understand and agree that in this case we have the right to use the de-identified information, and without disclosing your personal data, we have the right to analyze and commercially utilize the user database.
  3. Please note that all personal data you provide when using our products and/or services will continue to be authorized for us to use during your use of our products and/or services, unless you delete it or refuse us to collect it through system settings. When you cancel your account, we will stop using and delete your personal data.
  4. We will collect statistics on the use of our products and/or services, and may share these statistics with the public or third parties to show the overall usage trends of our products and/or services, but these statistics do not contain any of your personally identifiable information.
  5. When we display your personal data, we will desensitize your information by means of content replacement and anonymization to protect your information security.
  6. When we want to use your personal data for other purposes not specified in this policy, or when we use information collected for a specific purpose for other purposes, we will ask for your consent in advance by asking you to actively check the box.

When you use our products and/or services, we may need to collect and use the following two types of your personal data:

  1. In order to provide you with the basic functions of our products and/or services, you must authorize us to collect and use the necessary information. If you refuse to provide the relevant information, you will not be able to use our products and/or services normally;
  2. In order to provide you with additional functions of our products and/or services, you must authorize us to collect and use additional information. If you refuse to provide the relevant information, you will not be able to use the relevant additional functions or services normally.

EARMOR Intelligent Voice will only collect and use your personal data for the following purposes described in this policy:

Information about personal permissions that the software may need to collect and use:

  1. Allow the application to take photos and videos – for users to actively upload logs and scan code input functions.
  2. Allow the application to read photos, media content, and files on the memory card – in the simultaneous interpretation and conference assistant function modules, it is used to save the user’s simultaneous interpretation/conference records locally.
  3. Show pop-up boxes and full-screen interfaces on other applications – Call floating window permissions, and when playing third-party videos, real-time translated subtitles can be displayed on the floating subtitle box.
  4. Allow the application to obtain accurate location information (including latitude and longitude) based on network sources such as GPS, base stations, and Wi-Fi. – Used to obtain location permissions to implement real-time navigation functions.
  5. Allow the application to record audio – Used to obtain microphone permissions, record audio for voice transcription and translation.
  6. Obtain application installation list permissions – Used to detect whether it is installed when logging in with a third party.

Software function description:

  1. Translation/voice transcription function
  2. When using the translation/voice transcription function, in order to better provide recording, translation, voice-to-text and other related services, we will collect necessary user information based on the specific functions of the service you use:

    1. System default language. Used to match the APP default language and translation default language for you.
    2. Customized translation information. Used to save the professional terms, place names, fixed collocations, idioms and other information that the user has set, so that it can be synchronized through the user account after changing the phone.
    3. Customized settings information. Used to save the various parameter information that the user has set in specific functions, so that it can be synchronized through the user account after changing the device.
  3. Real-time navigation function
  4. In order to provide real-time navigation, route planning and location services, we need to collect the following information:

    1. Precise location information. Used to determine your current location and provide accurate navigation guidance and route planning. Even when the application is running in the background or the screen is turned off (in silent mode), it is necessary to continuously obtain your location information in order to provide real-time navigation services, route updates and arrival reminders. We only collect location information when you actively use the navigation function. When you exit the navigation function, we will stop collecting location information.
    2. Device direction and motion sensor data. Used to determine your movement direction and speed to provide a more accurate navigation experience.
    3. Network status information. Used to ensure timely update of navigation data and loading of map information.
  5. Feedback function
  6. When you contact us about APP issues, you can leave your comments in the feedback and we will contact you as soon as possible.

  7. Data statistics function
  8. In order to provide better products and/or services and improve user experience, we will collect device attribute information (such as your hardware model, operating system version, device configuration, unique device identifier, international mobile equipment identity code IMEI, network device hardware address MAC, advertising identifier IDFA, etc.), device connection information (browser type, telecom operator, language used) and device status information (such as device sensor data, device application installation list). For the information collected from your various devices, we may associate them so that we can provide you with consistent services on these devices.

  9. Secure transactions

To improve the security of your use of services provided by us and our affiliates and partners, protect the personal and property safety of you or other users or the public from infringement, better prevent phishing websites, fraud, network vulnerabilities, computer viruses, network attacks, network intrusions and other security risks, and more accurately identify violations of laws and regulations or EARMOR intelligent voice-related protocol rules, we may use or integrate your account information, transaction information, device information, software usage records, click records, and information that our affiliates and partners obtain your authorization or share in accordance with the law to comprehensively judge your account and transaction risks, conduct identity authentication, detect and prevent security incidents, and take necessary recording, auditing, analysis, and disposal measures in accordance with the law.

The above services may require you to open your unique device identification code, geographic location (location information), location (access to precise location), microphone, and mobile phone storage access rights to us in your device to enable the collection and use of information involved in these functions. You can decide to turn these permissions on or off at any time in your phone or device settings Close.

Please note that by opening these permissions, you authorize us to collect and use these personal data to achieve the above functions. By closing permissions, you cancel these authorizations, and we will no longer continue to collect and use your personal data, and we will not be able to provide you with the above functions corresponding to these authorizations. Please note that according to the relevant national laws and regulations, EARMOR Smart Voice does not need your authorization to collect and use your personal data in the following circumstances:

  2. Directly related to public security, public health, and major public interests;
  3. Directly related to criminal investigation, prosecution, trial, and execution of judgments;
  4. For the purpose of safeguarding your or other individuals’ major legitimate rights and interests such as life and property, but it is difficult to obtain your consent;
  5. The personal data involved is disclosed to the public by you;
  6. Personal data is collected from legally disclosed information, such as legal news reports, government information disclosure and other channels;
  7. Necessary for maintaining the safe and stable operation of the products or services provided, such as discovering and handling product or service failures;
  8. Related to EARMOR Smart Voice’s performance of obligations prescribed by laws and regulations.

Please be aware that, in accordance with applicable laws, if we take technical measures and other necessary measures to process personal data so that the data recipient cannot re-identify a specific individual and cannot restore it, or we may conduct de-identified research, statistical analysis and prediction on the collected information to improve the content and layout of EARMOR intelligent voice, provide product or service support for business decisions, and improve our products and services (including using anonymous data for machine learning or model algorithm training), then the use of such processed data does not require additional notification to you and your consent.

III. How we use cookies

We will not use cookies for any purpose other than the purposes described in this privacy policy. You can manage or delete Cookies according to your preferences. You can also clear all Cookies saved in the software.

IV. How do we share, transfer, and publicly disclose your personal data

(I) Sharing

  1. We will not share your personal data with any company, organization, or individual other than EARMOR Smart Voice and its partners, except in the following cases:
    1. Obtain your explicit consent or authorization in advance;
    2. Provide when necessary in accordance with applicable laws and regulations, legal procedures, mandatory administrative or judicial requirements;
    3. Provide within the scope permitted by laws and regulations to protect the interests, property, or safety of “EARMOR” or “EARMOR” partners, you or other EARMOR users, or the public from damage;
    4. Only by sharing your information can we realize the core functions of our products and services or provide the services you need;
    5. Handle disputes or disputes between you and others as needed;
    6. Comply with the relevant agreements signed with you (including online electronic agreements and corresponding rules) or other legal documents;
    7. Use based on academic research;
    8. Use based on social public interests in accordance with laws and regulations.
  2. We may share your personal data with our affiliates, but we will only share necessary personal data and be subject to the purposes stated in this Privacy Policy. If our affiliates want to change the purpose of processing personal data, they will ask for your authorization again.
  3. We may share your order information, account information, device information and location information with partners and other third parties to ensure the smooth completion of the services provided to you. However, we will only share your personal data for legal, legitimate, necessary, specific and clear purposes, and will only share personal data necessary for providing services. To comply with the law, enforce or apply our Terms of Use and other agreements, or to protect the rights, property or safety of EARMOR, you or other EARMOR users, such as to prevent illegal activities such as fraud and reduce credit risk, and to exchange information with other companies and organizations. However, this does not include selling, renting, sharing or otherwise disclosing personal data for profit in violation of the commitments made in this Privacy Policy.

(II) Transfer

We will not transfer your personal data to any company, organization or individual, except in the following circumstances:

  1. Obtain your explicit consent or authorization in advance;
  2. Provide in accordance with applicable laws and regulations, legal procedures, mandatory administrative or judicial requirements;

V. How we protect and store your personal data

However, without your explicit consent, we will not reduce the rights you should enjoy under this Privacy Policy. We will issue an updated version through EARMOR smart voice and remind you of the update of relevant content through EARMOR smart voice or other appropriate means before it takes effect.   2. For major changes, we will also provide more prominent notifications (we will explain the specific changes to the privacy policy through methods including but not limited to email, SMS or special reminders on the browsing page)

Major changes referred to in this policy include but are not limited to:
